(hereinafter referred to as HOTELISTIC), with its registered office at Passatge Forasté, 4, 1D, 08022, Barcelona, and Tax ID (CIF) B42792259. On the other hand, the individual, hereinafter referred to as the USER, accesses the website to obtain information and contract the services offered through the portal.
Before proceeding with any service contract, the USER is required to read these Terms and Conditions and explicitly accept them by clicking the button at the end of the form: "I have read and accept the Terms and Conditions". If the USER does not accept these terms, they must refrain from contracting the services offered by HOTELISTIC.
2. PURPOSE OF THE SERVICES OFFERED
HOTELISTIC provides its services through the website www.weglobeyou.com (hereinafter referred to as THE PAGE), offering tourism-related services to users.
To deliver these services, HOTELISTIC holds all the necessary permits and licences required to operate within its industry. These general terms of use regulate the generic use of the portal, as well as the effective contracting of hotel booking services.
However, the specific terms and conditions for individual bookings will apply to each specific case.
Similarly, the USER agrees to accept and comply with the purchase terms and conditions established by any hotel entity with which the USER chooses to contract. These include, but are not limited to, the payment of any incurred amounts and adherence to any rules or restrictions regarding the availability of rates, products, or services.
If there are special rules or restrictions applicable to specific rates, products, or services selected by the USER, these will be displayed on-screen before proceeding with the booking. On the other hand, the individual, hereinafter referred to as the USER, accesses the site to obtain information and contract the services offered through the portal.
3. PREREQUISITES
To begin the contracting process, the USER must meet the following prerequisites, which are not considered part of the contracting process itself:
Conduct a search for one or more services using the relevant search tool provided by HOTELISTIC on THE PAGE, and select the product(s) or service(s) of interest.
Accept these General Terms and Conditions, which are made available prior to the start of the contracting process and can be downloaded and printed from THE PAGE. This acceptance is completed by ticking a checkbox provided for this purpose, labelled: "I have read and accept the purchase terms and conditions."
4. CONTRACTING PROCEDURES
The contracting of services through THE PAGE will follow this process:
Once the General Terms and Conditions have been accepted and the service selected, the USER will be directed to a page where they must enter the personal details of the beneficiary in whose name the reservation is being made.
All data collected will be handled in accordance with THE PAGE's Privacy Policy.
Next, the necessary payment information will be requested. Payment can only be made by credit card through the payment gateway provided for this purpose.
All payment data collected will also be processed in compliance with THE PAGE's Privacy Policy.
The reservation(s) made by the USER will be subject to the specific terms and conditions established by the providers or organisers of the selected products or services.
These terms, outlined in the next clause, must be reviewed and agreed upon by the USER. This includes, but is not limited to, compliance with any rules and restrictions regarding the availability of rates, products, or services.
The USER shall provide consent by clicking the "Place Order" button located at the bottom of the payment information page. This confirmation will be sent electronically to HOTELISTIC, which will ensure its storage and preservation to guarantee the process.
Confirmation of the purchase by the service provider will constitute the completion of the contract and the client's commitment to pay the specified amounts.
Once consent is given, a confirmation page will appear on-screen, and an email containing the details of the purchase will be sent to the client.
5. SPECIFIC TERMS AND CONDITIONS
The specific terms and conditions of each service, including but not limited to pricing, modifications, cancellations, and other aspects not covered in these General Terms and Conditions, will be governed by the policies set forth by the respective service providers. HOTELISTIC, acting solely as an intermediary, does not assume any obligation or responsibility regarding such modifications.
These Specific Terms and Conditions will be considered accepted as outlined in the previous clause. If the specific terms and conditions do not allow for changes or cancellations by the client, the client will not be entitled to a refund of the amount paid to HOTELISTIC for the reservation.
6. OBLIGATIONS OF HOTELISTIC
HOTELISTIC is committed to the following:
To make every effort to carry out the necessary procedures to finalise the USER's acquisition of the service contracted through THE PAGE.
To provide the USER with the necessary documentation required to enjoy the contracted service.
To comply with all other obligations outlined in these General Terms and Conditions, as well as in the Specific Terms and Conditions detailed in Clause Five.
7. OBLIGATIONS OF THE USER
The USER agrees to the following:
To pay the corresponding amounts, including any applicable fees and taxes.
To personally ensure the authenticity of the data provided, as well as its accuracy in reflecting their identity when giving consent and making payment.
To take full responsibility for not possessing the required documentation to enjoy the contracted service. This includes informing themselves about the necessary requirements, particularly those related to border entry into third countries.
To comply with all other obligations outlined in these General Terms and Conditions, as well as those specified in the Specific Terms and Conditions detailed in Clause Five.
8. RESPONSIBILITIES
Both parties acknowledge that, as a mere intermediary between service providers and the USER, HOTELISTIC is only liable to the extent established by the applicable legislation governing travel agencies.
They also acknowledge that HOTELISTIC cannot guarantee the absolute continuity of the service or the absence of computer viruses in the services provided through its network that could alter programs or documents stored in its information systems. However, HOTELISTIC will make every effort to prevent such occurrences.
HOTELISTIC shall not be held responsible for inaccuracies, untruthfulness, or outdated information regarding schedules, prices, or other relevant details about services offered on the website by its respective providers. Nor is it responsible for any failure or defective performance by these providers of obligations arising from applicable regulations or the terms and conditions of sale for each booking made through THE PAGE.
In cases of force majeure (including, but not limited to, political unrest, economic instability, or safety-related issues) that result in deficiencies in reservations, confirmations, and/or execution of any travel or services contracted through HOTELISTIC, or if it becomes impossible to fulfil some of the agreed-upon services due to unforeseeable or unresolvable circumstances, the client agrees to waive any claims against HOTELISTIC, present or future, for such deficiencies or non-compliance. This waiver applies unless it can be demonstrated that HOTELISTIC acted without professional diligence.
9. IMPOSSIBILITY OF HANDWRITTEN SIGNATURE
Due to the specific nature of remote contracting, the USER acknowledges the impossibility of signing a payment receipt, which is traditionally used to confirm a transaction.
For this reason, the USER waives the requirement of a handwritten signature for any electronic transaction generated as a result of a reservation made through THE PAGE for any of the services offered. Instead, the USER confirms their agreement through the procedure outlined in Clause Four of these General Terms and Conditions of Contracting.
10. ERROR CORRECTION
HOTELISTIC provides its clients with an email address (available on the Contact page) through which the USER can report any errors detected during the data entry process in the course of contracting.
In this regard, the USER will have a period of 24 hours from the time of purchase confirmation to contact HOTELISTIC for this purpose.
11. MODIFICATION
HOTELISTIC reserves the right to unilaterally modify these General Terms and Conditions at any time deemed necessary, as well as to introduce new clauses.
Such modifications will be announced on the homepage of THE PAGE with a prior notice of two (2) weeks and will not, under any circumstances, affect contractual relationships established prior to the modifications.
12. DATA PROTECTION
Any data processing resulting from the execution and fulfilment of these General Terms and Conditions will comply with the provisions outlined in the Privacy Policy, which is made available to the client on THE PAGE. For these purposes, the Privacy Policy will be considered an integral part of these Terms and Conditions. (Spain).
13. SEVERABILITY
The declaration of nullity of any clause or clauses in these General Terms and Conditions by the competent authority will not affect the validity of the remaining clauses.
In such a case, HOTELISTIC commits to drafting a new clause to replace the nullified one, maintaining as close a resemblance as possible to the original. If substitution is deemed impossible and the clause is considered essential to the Contract, the party adversely affected by its removal may choose to terminate the Contract.
14. FINAL JURISDICTION
With an explicit waiver of any other jurisdiction that might apply, both parties agree to submit to the Jurisdiction and Competence of the Courts and Tribunals of the client's domicile.
Our website does not constitute, nor should it be interpreted as, a recommendation or promotion of the quality, service level, or classification of any hotel. The star rating of hotels, carried out in accordance with international conventions, provides non-binding information about the hotel's category.
